Subject : Meeting of Nodal officers of various Departments – implementation of the recommendations of the 7th CPC – Issues on way ahead.

In order to process the recommendations of the 7th Central Pay Commission, the Cabinet has approved setting up of an Empowered Committee of Secretaries chaired by the Cabinet Secretary. Accordingly, the ECOS has been set up as per this Ministry’s OM No.1-4/2015/EIII-A dt. 27.1.2016 (copy placed on the website of this Ministry, viz, www.finmin.nic.in).

2. As provided in the said OM dt. 27.1.2016, the Implementation Cell created in this Ministry shall work as the Secretariat for the ECOS.

3. This Ministry has already requested all the Ministries/Departments vide DO letter No.1-4/2015/EIII.A dt. 21.11.2015 from JS(Pers) addressed to all the Secretaries to nominate a nodal officer at the level of a Joint Secretary to interact with the Implementation Cell during the curse of processing of the recommendations of the 7th CPC.

4. Accordingly, Joint Secretary (Implementation Cell) shall take a meeting of all the Nodal Officers of the Ministries/Departments on 2.2.2016 at 11 .00 a.m. in Conference Hall (R. No. 72), North Block, New Delhi to discuss the relevant issues in connection with the processing of the recommendations of the 7th CPC and to concretise the points of action pertaining to all the Ministries/Departments in general and also in regard to specific issues concerning individual Ministries/Departments with a view to enabling an effective, holistic and quicker processing of the recommendations of the 7th CPC and for submission of the matter before the ECOS.

5. As this is the first meeting of the Nodal Officers to formulate the action points on the way ahead on processing of the recommendations of the 7th CPC, it is requested that the concerned nodal officers may kindly make it convenient to attend the meeting.

Seventh Pay Commission Correctly Predicts DA Hike To 125 Percent From January

New Delhi: The Seventh Pay Commission headed justice A K Mathur has correctly predicted the dearness allowance (DA) hike to 125 per cent from the existing 119 per cent since January 2016.

The Seventh Pay Commission in its report, submitted to Finance Minister Arun Jaitley, said that fitment of pay matrix of the central government employees was made assuming that the rate of Dearness Allowance (DA) would be 125 percent at the time of implementation of the new pay as on January 2016.
The average rate of retail inflation for industrial workers from January 1, 2015 to December 31, 2015 works out to be 6.82 percent, according Consumer Price Index—Industrial Workers data for December was released by Labour Ministry today.
Thus, entitling the central government employees to 6 percent additional DA from January 1, 2016.
The DA of employees would increase from 119 per cent on July 1, 2015 to 125 per cent on January 1, 2016.
However, the central government employees’ unions are not very enthused by the 6 per cent hike in the dearness allowance as their demand of implementation of Seventh Pay Commission award with higher minimum pay as well as some modifications in their favours.
It is added that the Empowered Committee of Secretaries (CoS) headed by Cabinet Secretary P K Sinha for processing the report of the Seventh Central Pay Commission, will hold its first meeting on February 2 to review the pay commission recommendations.

Eighteen years after he was suspended from the Indian Revenue Service (IRS) and slapped with corruption cases by the CBI, Ashok Kumar Aggarwal Wednesday got relief from the Delhi High Court.
In a 127-page order, the bench of Justice Siddharth Mridul set aside the sanction for prosecution granted by the government and the charges framed by the CBI against Aggarwal.
The court also observed that the agency’s investigation against Aggarwal “smacks of intentional mischief”.
“… In my opinion it would be unfair, unjust and contrary to the interests of justice to expose the petitioner to another round of litigation and keep him on trial for an indefinitely long period,” held the bench.

             We beg to state that at present large numbers of Gr-A posts  are lying vacant in the field formations of Central Board of Excise and Customs due to delay in conducting DPCs because of several  court cases. It may not be out of place to state that if large number of Gr-A posts will not be filled up, for a long period that will be caused an adversely affect to the revenue collections and result in tardy Tax  Payer Service. At present lot of Show Cause Notices  are pending for  Adjudication.
2. Further at  any time Government may introduce GST for which the number of assesses may increase manifolds and consequently the work load of the CBEC will increase causing requirement of more Gr-A officers in the rank of Asst. Commissioner/ Deputy Commissioner for CBEC.
3. Recently DOPT has issued guidelines for engagement retired Central Government Officers to work full time on contractual basis till attaining the age of 65 years on a fixed remuneration against vacant posts till regular incumbents become available. Few circulars issued by different Central Government departments are enclosed here with for your kind perusal.
     Under the circumstances , we request that necessary action may please be initiated at your end for engagement of retired promote IRS(C&CE) officers against vacant posts till regular incumbents are available in the interest of revenue.

IPS, IRS Officers Seek Fair Representation On Empowered Committee On 7th Pay Commission

New Delhi: Seeking to check IAS dominance, a confederation representing thousands of IPS, IRS officers among 20 civil services, has sought fair representation on an empowered committee that will examine the 7th Central Pay Commission recommendations.

The COCSA demanded in a memorandum that the representation of any one service should be restricted to 25 per cent of the total strength of the empowered committee to Cabinet Secretary P K Sinha and Expenditure Secretary Ratan Watal recently.
In a memorandum submitted to Cabinet Secretary P K Sinha and Expenditure Secretary Ratan Watal recently, it demanded that the representation of any one service should be restricted to 25 per cent of the total strength of the committee.
The Union Cabinet had on January 13 given its approval for setting up an empowered committee of Secretaries under the Cabinet Secretary to process the recommendations of the pay panel.
The move assumes significance as various civil services have been raising their voice against career benefits enjoyed by officers of the Indian Administrative Service (IAS) and Indian Foreign Service ( IFS).
The Confederation of Civil Services Association (COCSA) has highlighted the “apprehensions” shared by a “majority” of officers and requested for a fair representation to other services on committee, limiting the representation of any one service to 25 per cent of the total strength, said senior IRS officer Jayant Misra, its convener.
The COCSA had in December forwarded a memorandum and sought an appointment with the Cabinet Secretary to explain to him the “concern” of these officers.
“We are still waiting for an opportunity to meet the Cabinet Secretary. We have submitted fresh Memoranda dated January 19, 2016 to the Cabinet Secretary and also to the Expenditure Secretary, reiterating our demand that equitable representation be given to various services in all the bodies or committees etc. looking into or implementing recommendations of the 7th CPC, so that there is no domination by any particular service,” he said.
Amid a bitter war of words among services, the confederation maintained “that officers from various services continue to maintain excellent interpersonal relations and serve the Government with full devotion”.
“Cohesion and camaraderie among various civil services are essential pre-requisites for good governance and efficient public service delivery.
“The onus of strengthening these attributes lies on the officers of these services, but somewhat more on the officers who control the service conditions of the services, particularly when they are expected to render absolutely objective and neutral advice to the competent authorities, even if it may be perceived as disadvantageous to their own service,” the memorandum said, citing its concern.
In the present context, strong evidence was presented before the Pay Commission regarding unfair, unjustified and exclusive edge to two services, the confederation said.
“Our arguments were accepted and favourable recommendations were made by the Commission in a majority voice, and the final decision will be taken by the Cabinet in due course,” it said referring to the report submitted by the pay panel in November last year.
Two factors, however, raised concerns among thousands of officers whether the recommendations of the Commission will ever be taken to logical conclusion.
“First, the dissenting notes of one member of the Pay Commission in violation of the time-honoured principle of ‘nemo judex in causa sua’ (No one can be a judge in his own cause), and second, the very meagre level of compliance of the PMO’s instructions of reducing the huge inter-service gap in empanelment to the Joint Secretary level by December 2015.
“When instructions from even the highest office of the country are not being complied, one cannot blame the affected officers if they get hugely disappointed and agitated, and approach the service associations for espousing their cause,” said the COCSA, that comprises 20 services including IPS, Indian Revenue Service, Indian Forest Service, Indian Audit and Accounts Service and Federation of Railway Officers Association (representing nine railway services).

Centre To Challenge All Court Orders Favouring Its Employees

New Delhi: All court orders that favour employees and quash government policies will be challenged, as per draft guidelines finalised by the Centre.

The move comes as various ministries are making several references to the Department of Personnel and Training (DoPT) seeking interpretation of existing guidelines “without exercising due diligence”.
The ministries are advised not to make any references unless there are difficulties relating to interpretation or application of these guidelines or any relaxation in rules or instructions is warranted to mitigate a genuine hardship faced the government servant, the DoPT has said in the draft guidelines through Office Memorandum F.No.28027/1/2016-Estt.A-III dated January 22.
In case where the judgement has gone in favour of applicant or petitioner and a scheme or guidelines outlining government policy has been quashed, “the administrative department may take a decision to file Writ Petition or Special leave Petition (as the case may be) in consultation with DoPT and Department of Legal Affairs”, it reads.
Citing existing instructions, the DoPT said a common counter reply should be filed before a court of law on behalf of the Union of India by the concerned administrative department or ministry where the petitioner is serving or has last served.
“A unified stand should be adopted instead of bringing out each department’s or ministry’s point of view in the said reply. It further provides that it is primarily the responsibility of the administrative ministry to ensure that timely action is taken at each stage a court case goes through and that a unified stand is adopted on behalf of government of India at every such stage,” the DoPT said.
In no case should the litigation be allowed to prolong to the extent that it results in contempt proceedings, it said.
In case where the policy of DoPT has not been quashed, but the judgement or order of court or a tribunal has gone in favour of respondents or applicants, “the administrative department may take a decision to file Writ Petition or Special Leave Petition (as the case may be) in consultation with DoPT and DoLA”, the draft proposal said.
The DoPT has sought comments on these guidelines from all ministries by February 5.
