Membership, Subscription and Funds

 AC meeting of Association was held 26.02.22. It was decided to, first of all, make the Association strong financially by way of subscription and donation as we have to fight so many legal cases as narrated in earlier post. Needless to say that these cases, more or less, will benefit each member and some more cases may also be filed. Accordingly, it was decided in meeting that every member will subscribe with 1000/- yearly and also donate at least 5000/- yearly  to Association. Entry fee will also be 1000/- per individual. Wherever state unit affiliated to All India Association exists, subscription & entry fee wil be paid through affiliated state unit. Donation,   however, will be paid to All India Association directly. Association has already applied for PAN to open bank account. Meanwhile, following account will be used for the purpose-

Sharma also promised to deposit 50000/- (Fifty thousand) more on behalf of members from Mumbai. Vice President Sh. Anand Kishore and Joint Secretary Sh. Subrata Choudhury have also deposited Rs. 5000/- each.

F. Writ for parity in promotions with Exmnrs being prepared.

G. We also have to fight MACP case in Supreme Court against SLP to be filed by CBIC against Jabalpur High Court Order.

H. We may also have to file/fight some more cases in the interest of cadre.

Sir,
Kindly refer to your office letter issued vide F. No. 38/02(01)/2022-P&PW(A) (7691) Dt. 20.01.22 addressed to various departments regarding additional quantum of pension on attaining the age of 65, 70 and 75 years based on 110th report of Parliamentary Standing Committee to give due justice to pensioners and family pensioners.
2. It is submitted with due regards that it is really a welcoming step and was long needed for the pensioners and family pensioners. But it seems that they need even a better deal because of their various needs being increased with age and also because of recovery of approximate double the commutation value in case of commutation of pension.
3. According to the present scheme, a consolidated amount reckoned at the commutation value of 8.194 years is disbursed to the pensioner at the time of retirement whereas recovery is affected for 15 years, i.e, for approximately double the commutation value. As per a Note prepared by Ministry of Personnel, Public Grievances and Pensions, Department of Pension & Pensioners’ Welfare {File F.No.42/8180/2011-P&PW (G)}, the rate of interest at which commuted value of pension is fully recovered is 20.7% per annum in the case of employees who retired at the age of 60 years after 01.01.06. This is, in fact, gross injustice to the poor pensioners. It is also worth to submit that it is helplessness of the employees to get the pension commuted at the time of retirement due to their prevailing circumstances and need to meet various expenses after retirement. The fact is that they are forced to get the pension commuted to fulfil instant family obligations because of the fact that amount of pension is even less than the actual cash in hand as salary on account of no allowance except DA being granted to the pensioners and family pensioners. The family pension also becomes half of the pension on demise of the pensioner.
4. The pension structure gets seriously dis-aligned as 50% increase in living price takes place even in less than 5 years. This results in considerable erosion of the financial position of the pensioner and family pensioner. Dearness Relief does not adequately take care of the inflation at this level. Working employees are rightly getting automatic relief by way of 25% increase in their allowances with every 50% rise in Dearness Allowance alongwith annual increment in pay. As pensioners do not get any allowance or annual increment, they feel discriminated and helpless in the present scenario of high inflation, climatic changes including incidence of pesticides/chemicals & rising pollution. Old age disabilities/diseases also set in by the time an employee retires and go on manifesting very fast needing additional finances to take care of these disabilities and diseases. Senior citizens, during their advanced age, have also to bear additional financial burden due to social & family obligations. 
5. In view of the above, it is requested that the government may also kindly consider to grant annual increment to the pensioners and family pensioners at a fair rate to be decided by the government itself in addition to the additional quantum of pension after every five years.

 THE ALL INDIA PENSIONERS’ ASSOCIATION OF CBIC.

 

Minutes of 3rd National Conference/General Body meeting of the Association held on 15.02.2022  at 7 AM to 9.30 AM on  virtual mode.

 

The meeting was inaugurated by Shri A.K.Sharma , President, on virtual mode however after inauguration Shri Sharma took leave on certain personal grounds. Then on request Shri S.K.Pareek was presided over the meeting on virtual mode.

 

1.    The minutes of the last meeting was approved.

2.    The Secretary General presented his report in short cut, which was approved after discussions.

3.    Discussions were made on all Old/ Unfinished Agenda Points -  ( Pay parity/MACP/NFGP/notional promotion due to delay in conducting DPCs and non fixation of proper ratio in promotions/restoration of old pension scheme/Sanction of freezed arrears of DA) and all New agenda  items: - ( a.  Pension should be exempted from Income Tax. b. Continuance of cashless benefits to pensioners under CGHS scheme. C. Registration of the Association under Society Act at Delhi on all India basis.) After discussions it was resolved that the new body shall take all initiatives to settle all these grievance points as early as possible.

4.    Shri C.S. Sharama, IRS, Asst. Commissioner, Customs, Delhi was requested to conduct election of office bearers of the Association for the tenure 2022-25. Shri Sharma agreed and conducted the election. The following members were elected for the posts as stated below against each of their names:

A.   President- Shri A.K. Sharma.

B.   Vice Presidents-  A.Venkatesh, N.N.Lal, J.P. Sharma, Santanu Roy, Anand Kishore.

C.    Secretary General- Ravi Malik.

D.   Joint Secretaries- S. Chandrasekar, Rajender Kumar, Atar Singh, Subrata Chaudhury, B.C. Barthwal.

E.    Advisory Committee- Chief Adviser-  L.Mishra, Advisers- G.C. Roul & Ramesh Babu. 

5.     The Secretary General (elected) had nominated for the post of Organising Secretary to Chittaranjan Sastry, , Organising Secretary -cum- Office Secretary to V.K.Sharma and for the post of Finance Secretary to Raj Kumar in accordance with the provisions of the Constitution of the Association.

6.    It was resolved that the new committee shall try to create more units through out the country as per the provisions of the Constitution of the Association by taking assistance from different service Associations of the field formations of CBIC for affiliation under the Association. There are few interdependent registered pensioners associations of different retired employees of CBIC  existed at Chandigarh, Bhubaneswar, Hyderabad, Kolkata, Cochin etc, hence the new committee shall try to affiliate such associations under the All-India Pensioners’ Association of CBIC.

7.    It was resolved that the new committee shall immediately challenge the seniority list of ACs for 2002 to 2013 issued by CBIC recently. The new Committee also submit a representation to solve all the MACP anomalies (such as adhoc promotion should not be considered one up gradation, effective date of MACP should be 01.01.2006, 3rd MACP should be GP 6600 in PB-3, granting NFGP should not get up set one upgradation under MACP etc) . The new committee shall also submit a representation for granting one increament to the persons having date of birth 1st July and retired on 30th June during 6th CPC period. The new Committee shall also submit a representation for granting notional promotion to the officers who retired without getting promotions due to delay in conducting DPCs and non fixation of appropriate ratio etc.

8.    The financial position of the Association was reviewed. The Financial Secretary had reported that the present balance is Nil. It was resolved that the new committee shall collect donations from the members for improvement of the financial position of the Association.

9.    The house was adjourned till the next National Conference/ General Body Meeting.

ALL INDIA PENSIONER’S ASSOCIATION OF CENTRAL BOARD OF INDIRECT TAXES & CUSTOMS.

Central Headquarters

CONSTITUTION

(This constitution was adopted by the National Conference of the Association held at New Delhi   on 10th and 11th March, 2016 and amended on 5th April, 2019 by the National Conference of the Association held at New Delhi)

1.      The name of the Association shall be “All India Pensioner’s Association of Central Board of Indirect Taxes and Customs”.

2.      Aims and objects: The object for which the Association is established are:

 (a)     To unite the entire retired officers /pensioners of field formations of Central Board of Indirect Taxes and Customs (previously known as Central Board of Excise and Customs) Government of India under the aegis of the “All India Pensioner’s Association of Central Board of Indirect Taxes and Customs” hereinafter referred to as “Association”;

  (b)     To safeguard and promote the interest of all    retired officers /pensioners of field formations of Central Board of Indirect Taxes and Customs (previously known as Central Board of Excise and Customs) Government of India.

    (c)     To do all such things as are incidental or conducive to the attainment    of the above objects or any of them.

3.      The Central Headquarters of the Confederation shall be at the residence of Secretary General.

4.      Composition:

          (a)     The Membership of the Association shall be open to all retired officers /pensioners of field formations of Central Board of Indirect Taxes and Customs (previously known as Central Board of Excise and Customs) Government of India ,through affiliated units.

          

          (b)    Forfeiture of rights:   Any affiliated unit of the Association who shall not pay the subscription    within 3 months from the end of the financial year shall forfeit the rights and privileges of affiliation at the discretion of the National Executive. However, the National Executive Committee may extend the date of deposit on exceptional case.

5.      Affiliation:

              The State units of the Association shall be eligible for affiliation subject to the provision made in Part II herein. One or more units in a State shall be formed   at the discretion of the National Executive.

 

6.      Affiliation fees:

          A fee of Rs.100 shall accompany the application for affiliation.

7.      Subscription

          Every affiliated unit shall pay an annual subscription at the rate of Rs.100/- (Rupees one hundred) only per member of the affiliated unit to the Association CHQ within the financial year.  The subscription shall be payable within 3 months from the end of the financial year failing which the certificate of affiliation shall be rescinded.   However, the National Executive Committee may extend the date of deposit on exceptional case.

 

8.      Management:

          The Management of the Association shall be vested in the following bodies:- 

           (a)    The National Conference, which shall meet once in three years. In exceptional Circumstances, the tenure may be extended by three months by the National executive committee.

             (b)     The National Executive committee which shall meet at least once in six months.

9.      Composition of National Conference,  and  National Executive committee :

          A. National Conference.

          The National Conference shall consist (a) office bearers of All India Association (b) National Executive Committee members (other than office bearers of All India Association) (c) President, General Secretary and delegates elected and nominated by the affiliated units of the Association. One delegate for each 100 members (50 to 100 shall be considered as  one and no delegate for less than 50)

          B.      National Executive Committee

          The National Executive Committee shall consist of

          (a)     Office bearers of All India Association.

          (b)     One member nominated by each and every affiliated unit of the Association. (President or General Secretary or any other office bearer or any other member of the Affiliated unit may be considered for  such nomination   by the concerned unit )

 

          10.    Powers and duties.

                   A. National Conference. The National Conference shall be the supreme body of the Association and shall have absolute control over the affairs and property of the Association apart from the following powers.

                   (a)     to elect office bearers listed in Article 13(b).

                   (b)     to consider and adopt the triennial report and accounts of the Association.

                    (c)     to effect or rectify changes in the constitution of the Association by decisions taken by the 2/3rd majority of the representatives assembled at the National Conference.

                   (d)     to decide all question on policy

                   (e)      to act as a final court of appeal against the suspension of any office bearers.

        B.   National Executive Committee:-                                     In between the sessions of the National Conference, the National Executive shall exercise all powers of the National Conference except as those specified in clauses (a) to (d) of article 10. National Executive Committee shall                                                                            however be competent to take decision on all matters not contrary to the decision of the National Conference. It shall have the powers to fill up the vacancies of the office bearers on majority decision.

11.    Powers and duties of  All India Office bearers.

          The office bearers shall be responsible to the National Conference, and National Executive Committee. The President shall preside over the meeting of the National Conference, and National Executive Committee  and exercise general supervision over the work of the Association. Vice presidents shall   perform the duties of the President in the absence of the President and shall assist him   in his work and on recommendation of Secretary General one of them shall preside over the meeting in absence of President. Secretary General shall be the chief executive officer of the Association. He shall conduct correspondence with all concerned, sign papers, maintain minutes books and shall perform all functions attached to the post.  The Joint Secretaries shall assist the Secretary General and work under him. On recommendation of President one of them shall also perform the duties of the Secretary General, in his absence.  Financial Secretary shall be nominated by Secretary General and shall be responsible for the funds of the Association and receive all fees, moneys and contributions on behalf of the Association and grant receipts. He shall be responsible for the proper maintenance of accounts of the Association. Organizing Secretary / Organizing Secretary cum- Office Secretary shall be nominated by Secretary General and shall assist the Secretary General in Organizational matters and shall perform specific duties assigned by the Secretary General.   Advisory Committee  consisting of one Chief Adviser and two advisers shall advice the All India Office bearers / National Executive Committee , whenever it shall be required any advice on any matters. 

12.    Voting in the Managing bodies.

          Each delegate/office bearer (President and General Secretary) of affiliated unit/ Members of National Executive Committee including office bearers of All India Association as the case may be shall have one vote. ( Finance Secretary, Organizing Secretary and organizing secretary cum office secretary shall have no voting power)

13.    Election:

          (a)     The delegate/Member of the National Executive Committee shall be elected or nominated by the respective affiliated units of the Association in such a manner as they may deem fit.

          (b)     The All India Office bearers: The following Office bearers shall be elected from among the delegates / office bearers( President and General Secretary) of affiliated units/ Members of National Executive Committee including office bearers of All India Association attending the National Conference in a democratic manner.  One election officer shall be nominated by Secretary General to conduct election in National Conference and decision of election officer on election matters shall be final.

          (i).      One President

          (ii)      Five Vice Presidents

          (iii)      One Secretary General

          (iv).     Five Joint Secretaries.

           (v) One Chief Adviser and two advisers. 

(c) Immediate after election the Finance Secretary,  Organizing Secretary and the  Organizing Secretary cum Office Secretary shall be nominated by Secretary General and they shall also be members of National Executive Committee without voting power.

 

14.    Expenses of Delegates//Executive Committee Members :

          The expenses of the delegates/ National Executive committee members/office bearers of affiliated units, other than the President, Secretary General, Finance Secretary ,Organizing Secretary, Organizing Secretary cum Office Secretary  and Chief Adviser/ Advisers  of All India Association shall be borne by the respective affiliates units of which he is a primary member. The expenses of the President, Secretary General, Finance Secretary , Organizing Secretary,  Organizing Secretary cum office secretary  and Chief Adviser/Advisers of All India Association shall be met out of the funds of the Association. The National Executive Committee is empowered to authorize meeting the expenses of any office bearers on exceptional circumstances.

 

15.    Tenure of Office:                       

          All the all India office bearers and members of the National Executive committee shall hold the office till the next conference.

16.    Auditor

          The Auditor shall be nominated by the National Conference and shall not be an all India  office bearer and shall audit the accounts of the Association.

 17.   Notice of meetings

          (a)         Notice of the meeting of the National Conference shall be served at least 30 days before the date thereof and notice of the National Executive Committee shall be served at least 15 days in advance.  In case of an emergency meeting, the notice period may be reduced by half.

          (b)         The notice of the meetings shall be served only to the affiliated units and not to the National Executive Committee members/Delegates individually except in the case of All India office bearers for whom the notice will be served individually.

18.    Quorum

          (a)         The quorum of a meeting of the National Conference shall be one fourth of its strength.

          (b)          The quorum of a meeting of the National Executive Committee shall be one third of its strength.

19.    Requisition meeting:  A requisition meeting of the National Executive Committee shall be convened, if 12 (twelve) members of the National Executive Committee give notice for the same.

20.    Funds:  The funds of the Association shall be deposited in a scheduled bank and operated jointly by the Secretary General and Finance Secretary. Subscriptions/Donation shall be collected by All India Association through affiliated units.

21.    Amendment in the Constitution.  No amendment to the Constitution shall be carried except by 75% of authorised delegates/members of National Executive Committee including all India office bearers present in the National Conference voting in favour of amendment(s) at the National Conference.

22.    Financial Year:  The financial year shall be from 1st April to 31 st March.

23. The Association shall be registered under registration of the Society Act and applied for grant from Government of India.

PART- II

1.      One or more units shall be formed at State levels consisting of all retired officers /pensioners of field formations of Central Board of Indirect Taxes and Customs (previously known as Central Board of Excise and Customs) Government of India at the discretion of the National Executive.

2.      The units shall have power to frame rules to suit the local conditions but not inconsistent with articles of the Constitution of the All India Association. The units shall elect office bearers in accordance with their approved constitutions/rules and run the affairs of the units as per such approved constitution/rules.

3.       The units shall apply for affiliation along with a   fee of Rs.100 and necessary affiliation shall be granted after approval in National Executive Committee.

4.           Every affiliated unit shall pay an annual subscription at the rate of Rs.100/- (Rupees one hundred) only per member of the affiliated unit to the Association CHQ within the financial year.   The subscription shall be payable within 3 months from the end of the financial year failing which the certificate of affiliation shall be rescinded However, the National Executive Committee may extend the date of deposit on exceptional case.

5.      The units shall faithfully carry out the directives of the All India Association and shall refrain from chalking out separate programmes on issues, which are already under the purview of the All India Association without prior intimation.

6.      The units shall collect subscriptions/donation from the members of the affiliated units.
